1The service

Fix & Restore Old Photos restores photos with the help of AI. You must be 18 or older to use it, and you confirm this when you start.

2Your photos and what you promise

You keep every right you have in your photos. By uploading a photo you promise that:

• you own it, or you have the permission you need to restore it (an old studio portrait can still be protected by copyright);
• you have the right to share the people in it with us for restoring, and the photo breaks no law and no one's rights.

3What you allow us to do

You give TESTIQ LLC, 1500 N Grant St Ste N, Denver, CO 80203, United States and the providers that work for us a limited license to process your photo, only to restore it for you and to run the service safely (for example, checking the photo for content that is not allowed). We do not use your photos for anything else, and they are deleted as described in the privacy policy.

4What is not allowed

You may not use the app to upload, create or share:

• any sexual image of a child, or anything that exploits or endangers a child;
• nude or sexual images, or images made or changed to show a real person in a sexual way, or without that person's consent;
• content that impersonates a real person in order to deceive;
• photos you have no right to use, or anything illegal.

We block what we can before it is processed, and we may refuse a photo, remove access, or report content to the authorities as the law requires.

5AI results

An AI makes the restoration. Results can differ from the person or the original: faces can change, and details can be added that were not there. Please check the result, especially the faces, before you rely on it. The app labels restorations AI-restored, and saved files carry metadata that says an AI modified them. Do not remove it to mislead anyone. Anyone can check the mark: open the saved file at contentcredentials.org/verify, or read its IPTC “digital source type” field with a photo tool.

6Credits, plans and ads

• The first 3 restorations are free. After that, a restoration costs credits, and the app shows what it costs before it starts.
• Credit packs never expire. Credits can only be used in this app, have no cash value and cannot be transferred.
• Credits change only on our server. If a restoration fails, or a photo is refused, your credit is returned.
• The optional plan renews each month or year until you cancel it in Google Play, and shows its price and renewal date. There are no free trials and no weekly plans.
• Payments are made through Google Play, which also handles refund requests: ask Google Play for a refund. A refunded or voided purchase takes its credits back. If you are a consumer in the EU or the UK and a restoration you paid for does not work as described, you can also write to us at support@testiq.io; your legal rights are not affected by Google Play's refund rules.
• Rewarded ads are optional and give one restoration at standard quality.
• Review access codes are for Google Play's reviewers only, carry no cash value, are non-transferable and can be revoked.

7Reports and takedowns

You can report a result in the app. If you believe something in the app infringes your rights, write to support@testiq.io with what it is, why, and how to reach you. We review reports and may remove access for people who repeatedly break these terms or the rights of others.

8Ending your use

You can stop at any time and delete your account in the app or on the website. We may suspend or end your access if you break these terms or misuse the app.

9No guarantees, and limits on liability

We work hard to make every restoration good, but an AI result cannot be guaranteed: we cannot promise that a restoration will be right for every photo, or that the service will never be interrupted. If you are a consumer in the EU or the UK, you have legal rights if a digital service is not as described or does not work as it should, and nothing in these terms takes them away.

As far as the law allows, we are not liable for indirect or consequential losses, and our total liability for a claim is limited to the amount you paid us in the 12 months before it. This limit does not apply to death or personal injury caused by our negligence, to fraud, to intent or gross negligence on our part, or to any liability the law does not let us limit.

10Settling disputes

If you live in the United States: you and TESTIQ LLC, 1500 N Grant St Ste N, Denver, CO 80203, United States agree to settle disputes by individual binding arbitration, not in court, except that either of us may go to small-claims court. You and we waive any right to a jury trial and to bring or join a class action or other group claim. You may opt out of arbitration within 30 days of first using the app by writing to support@testiq.io.

If you live in the EU, the UK or another place where the law gives you rights that cannot be waived, those rights, including the right to go to your local court, stay in place. These terms are governed by the laws of the State of Colorado, USA, without taking away the protection your local consumer law gives you.

11Changes and contact

We may change these terms when the app, the law or the services we use change. We will change the date above and, for a change that affects your rights, tell you in the app or by email before it takes effect, where we can. If you do not agree with a change, you can stop using the app and delete your account before it takes effect; credits you have bought stay usable until then, and for any purchase in the last 14 days you can ask Google Play for a refund.
